The following describes the Terms and Conditions applicable to the services available through this Site and your obligation and responsibilities and among other things, limitation of liability of Travelbolt.com, the operator of Travelbolt.com, the owners and directors of the Travelbolt brand. Before submitting an account registration form and/or using any of these services, please read all these Terms and Conditions carefully. By using the services, you acknowledge that you have read and understood and agree to be bound by these terms. By using our Website and/or completing a booking with us, you confirm that you accept these terms and any relevant Supplier's terms and conditions, and that you agree to comply with them. You must be at least eighteen (18) years old to use the services. If you do not agree with any part of these Terms and Conditions, you must not use this Site.

Travelbolt.com reserves the right, at its sole discretion, to amend the Terms and Conditions at any time by posting the amended terms on this site. The amended terms shall be effective from and after the date that they are posted. The Terms and Conditions may not otherwise be amended.

Copyright Notice

You, the User, acknowledge that all content included on this Site — including the information, data, software, photographs, graphs, video, typefaces, graphics, music, sounds, images, illustrations, maps, designs, icons, written and other material and compilations — are intellectual property and copyrighted works of Travelbolt.com and/or various third-party providers ("Providers"). Reproductions or storage of information or works retrieved from this Site, in all forms, media and technologies now existing or hereafter developed, is subject to the Copyright Ordinance (Cap.528).

You may use the materials on this Site only for your personal, non-commercial use. You may electronically copy or print extracts of materials from this Site for such purpose only and without alteration, addition or deletion. Any other use of the materials on this Site, including any reproduction or alteration, is prohibited unless with the prior written permission of Travelbolt.com.

"Travelbolt.com" is a registered trade or service mark used by G.C. Nanda & Sons Limited. Other product and company names identified on this Site may be the trademark, trade name, service mark, logo, symbol or other proprietary designation of a third party. The use on this Site of any name, trademark, trade name, service mark, logo, symbol or other proprietary designation or marking of or belonging to any third party, and the availability of specific goods or services from such third party through this Site, should not be construed as an endorsement or sponsorship of this Site by any such third party, or the participation by such third party in the offering of goods, services or information through this Site.

Acceptable Use

This Site is intended for personal, non-commercial use. You may use this Site only to make legitimate requests to purchase the products or services offered (each, a "Request"). You shall not use this Site to make any speculative, false or fraudulent requests or any requests in anticipation of demand. You represent that you are of sufficient legal age to create binding legal obligations for any liability you may incur as a result of your use of this site. You agree to provide correct and true information in connection with your use of this site, and you agree to promptly update your membership information (if applicable) to keep it current, complete and accurate.

Without prejudice to any other remedies available, Travelbolt.com reserves its right to suspend or terminate your account if you place a request by a false name or with an invalid credit card. It is a violation of law to place a request in a false name or with an invalid method of payment. Please be aware that even if you do not give us your real name, your web browser transmits a unique Internet address to us that can be used by law enforcement officials to identify you. Fraudulent users will be reported to the police and prosecuted to the fullest extent of the law.

Travelbolt.com reserves the right to cancel any airline reservation, tickets, hotel booking, rental car reservation or any other transaction that it reasonably believes to have been fraudulently made, including, by unauthorized use of a credit or debit card.

No Warranties

Unless a Provider has agreed otherwise, all products, services, advice, merchandise and information available through this Site are provided on an "as is," "as available" basis without warranties of any kind, either expressed or implied. These include, but are not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose. Without limiting the above, no warranty or guarantee is made:

• Regarding the acceptance of any Request.
• That a User will receive the lowest available price for goods and/or services available through this Site.
• Regarding the availability of products and/or services through this Site or, where applicable, at any participating retailer or retail location.
• That use of this Site and all software, products or services associated with this Site will be error free.
• Regarding the results that may be obtained from the use of this Site.
• Regarding the completeness, accuracy, reliability or quality of any information, content, data, service, advice or merchandise provided or available through this Site.
• Regarding the performance or non-performance of this Site.

You expressly agree that the use of this Site is at your own risk.

General Limitation of Liability

In no event shall Travelbolt.com, including its respective officers, directors, employees, representatives, affiliates (including, but not limited to, Travelbolt.com) or providers (collectively, the Covered Parties), be liable for any injury, death, loss, claim, act of god, accident, delay, or any direct, indirect, special, exemplary, punitive, incidental or consequential damages of any kind — whether based in contract, tort or otherwise — which arise out of or are in any way connected with any use of this Site, or with any delay or inability to use this Site, or for any information, software, products or services obtained through this Site, even if the Covered Parties have been advised of the possibility of such damages.

Further, the Covered Parties accept no responsibility for any damage and/or delay due to Provider cancellations, shortages, sickness, labor disputes, machinery breakdown, pandemics, epidemics, quarantine, government restraints, weather, fire, accidents, earthquakes, riots, strikes, wars, storms, acts of God or causes beyond the Covered Parties' control. No responsibility is accepted for any additional expense, omissions, delays, re-routing or acts of any government authority. No covered party shall be responsible for any Provider's breach of any warranty including, but not limited to, implied warranties of fitness for a particular purpose or of merchantability. Nor shall any Covered Party be responsible for any other wrongdoing of a Provider (including any liability in tort) as to any products and/or services available through this Site. No Covered Party shall be responsible for any Provider's failure to comply with these Terms and Conditions, nor for any Provider's failure to comply with applicable laws including, without limitation, laws governing the sale, warranty and return of perishables.

If, notwithstanding the above, a Covered Party is found liable for any loss or damage relating to the use of this Site, the User agrees that the liability of any such party shall in no event exceed the fee or charge to the User assessed by Travelbolt.com for making a Request.

We do not guarantee that our Website, or any content on it, will always be available or be uninterrupted. We may suspend, withdraw, or restrict the availability of all or any part of our Website for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.

Our Website provider is reliant on the internet and devices. You fully understand and agree that we will not be liable for any losses suffered by you because of our Website not being available due to events, circumstances or causes beyond our reasonable control, including but not limited to internet, system or device instability, computer viruses and hacker attacks.

Third Parties

If you use this Site to submit Requests for or on behalf of a third party ("Third Party"), you are responsible for any error in the accuracy of information provided in connection with such use. In addition, you must inform the Third Party of all Terms and Conditions applicable to all products or services acquired through this Site, including all rules and restrictions applicable thereto.

Each User using this Site for or on behalf of a Third Party agrees to indemnify and hold each Covered Party harmless from and against any and all liabilities, losses, damages, suits and claims (including the costs of defense), relating to the Third Party's or the User's failure to fulfill any obligations as described above. The User is directly responsible for any Request submitted, including related fees, charges and performance obligations.

Third Party Travel Service Providers

You may be bound by terms and conditions imposed by the travel service providers for whom Travelbolt.com acts as an agent including conditions of carriage, refund and cancellation policies of airlines, hotels, train, cruise lines, car hire operators, etc. ("Travel Service Provider(s)").

Travelbolt.com is not liable for any claims against non-fulfillment or unsatisfactory fulfillment of products and services purchased on your behalf by Travelbolt.com from these third-party providers and distributors, such as, but not limited to, airlines, hotels, train companies, tour operators, car hire companies, insurance companies, and other entities. At times, airlines and other travel services providers may overbook passengers on their flights or re-schedule flight times – Travelbolt.com is not responsible for any such incidents.

User Comments, Feedback and Other Submissions

All comments, feedback, suggestions and ideas disclosed, submitted or offered to a Covered Party in connection with your use of this Site (collectively, "Comments"), shall be and remain the exclusive property of Travelbolt.com and may be used by a Covered Party in any medium and for any purpose worldwide without obtaining your specific consent. For example, your Comments could be used on this Site and in radio, television and print advertisements. Your given name and first initial of your family name may be used with any Comments you submit. No Covered Party is under any obligation to maintain your Comments (and the use of your given name and first initial of your family name with any comments) in confidence, to pay you any compensation for any comments submitted, or to respond to any of your comments. You agree you will be solely responsible for the content of any comments you make.

Response to Requests

While Travelbolt.com will use its good faith efforts to respond to Requests within the time periods indicated on this Site, no guarantee is made that the status of your Request will be made available to you within the stated processing time. Neither Travelbolt.com nor its Travel Service Providers are responsible for any errors or delays in responding to a Request including, without limitation, errors or delays in responding to a Request caused by an incorrect e-mail address or other data provided by you or other technical problems beyond their control.

Links to Other Web Sites and Services

To the extent this Site contains links to outside services and resources, or to the extent that third party websites link to this Site, any concerns regarding such services or resources should be directed to the particular outside service or resource provider. Travelbolt.com does not monitor or control the linked sites and makes no representations regarding, and is not liable or responsible for the accuracy, completeness, timeliness, reliability, or availability of any of the content uploaded, displayed, or distributed, or products or services available at these sites. If you choose to access any third-party site, you do so at your own risk. The presence of a link to a third-party site does not constitute or imply Travelbolt.com's endorsement, sponsorship, or recommendation of the third-party, or of the content, products or services contained on, or available through, any such third-party site.

Termination of Usage

User access to all or part of this Site may be terminated or suspended at any time, and without notice for any reason.

Pricing Errors

Travelbolt.com endeavors to publish and maintain accurate prices and information for the services and products we offer. Our suppliers provide us with the price and other information related to these services and products.

In the event, however, that a service or product is listed or provided to us at an incorrect price or with incorrect information due to incorrect service or product information received from our suppliers, typographical error or system error or other error in pricing, we retain the right to refuse or cancel any orders placed for such service or product.

We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and/or your credit card charged. If your credit card has already been charged for the purchase and your order is canceled because of incorrect supplier information, we will promptly issue credit to your credit card account in the amount of the charge. Prices, rates and inventory are subject to availability from the Travel Service Provider.

Credit Card Submissions

All Requests must be submitted with a major credit card unless otherwise expressly stated.

Membership/Loyalty Program

If you are a member of any membership/loyalty program(s), please also refer to the terms and conditions applicable to such program.

Miscellaneous

You may only use our website for lawful purposes. By way of example, and not as a limitation, you may not use our website or services:

• In any way that breaches any applicable local, national or international law or regulation.
• In any way that is unlawful, fraudulent, unauthorised, or abusive, or has any unlawful, fraudulent, unauthorised, or abusive purpose or effect.

We and/or the Travel Service Providers reserve the absolute discretion to take any action as we consider appropriate to comply with the applicable laws or our internal policies, including but not limited to refusing to process or take part in any transactions or payment made or completed on our Site which may result in our or the Travel Service Providers' non-compliance with the applicable laws or our internal policies. Neither Travelbolt.com, the Travel Service Providers, nor any of its authorized officers, employees or agents will be liable for any loss, damage, expense, cost, claim or proceeding, whether direct, indirect or consequential, which you or any other person may suffer or face due to us exercising any of our rights under these Terms and Conditions.

The captions in these Terms and Conditions are only for convenience and do not, in any way limit or otherwise define the terms and provisions of these Terms and Conditions.

None of the Covered Parties is responsible for any errors or delays in responding to a Request caused by an incorrect e-mail address provided by you or other technical problems beyond their control.

These Terms and Conditions, and the related parts relating to each service and product, represent the entire Terms and Conditions between you and each Covered Party regarding your use of this Site and supersede any prior statements or representations. The laws of the Hong Kong Special Administrative Region shall govern the performance of these Terms and Conditions.

Limitation of Liability

Travelbolt.com is acting as an agent for airlines or other travel service providers (collectively, Travel Suppliers) in selling travel services, or in accepting reservations or bookings for such services to be provided to you. Travelbolt.com does not assume liability for any injury, damage, death, loss, accident or delay due to an act of negligence or the default of a Travel Supplier, or by an act of God. Further, no responsibility is accepted for any damage and/or delay due to sickness, pilferage, labor disputes, machinery breakdown, pandemics, epidemics, quarantine, government restraints, weather, fire, accidents, earthquakes, riots, strikes, wars, storms, acts of God or causes beyond Travelbolt.com's control. No responsibility is accepted for any additional expense, omissions, delays, re-routing or acts of any government authority. The contract of carriage in use by a Travel Supplier, when issued, shall be between the Travel Supplier and the passenger.

Ticket Restrictions

Airline tickets available through this Site are subject to the published conditions of carriage and rules of the applicable airline. Tickets may be purchased between 4 days and 330 days in advance. For tickets not originating from Hong Kong, they may be purchased between 5 days to 330 days in advance. Ticket restrictions and flexibility vary according to the type of fare purchased.

Ticket Payment

If the User submits a Request for tickets, the User agrees that if tickets satisfying the User's Request are located, the amount of the submitted Request — plus all taxes, charges, surcharges, delivery/handling and Request resubmission or other fees — will be charged automatically to the credit card submitted by the User. Such amounts will be posted on this Site.

Other Service Fee

There may be a processing / service fee per ticket for airline tickets purchased through this Site. Such non-refundable fee will be listed out for User's reference before User is required to enter the credit card number.

Fuel Surcharge Adjustment

The amount of fuel surcharge (if any) paid upon booking confirmation is an estimated cost only. Fuel surcharge is subject to adjustment (either increase or decrease) due to individual policies of airline companies. Travelbolt.com will redeem extra amount paid by customers (if any), and at the same time, reserves the right to request customers to pay for the additional amount.

Use of Ticket in Right Sequence and Changes in Itinerary

Tickets are valid only for transportation shown on the itinerary from the place of departure through any agreed stopping places to the final place of destination. Ticket must be travelled in sequence. If customers do not show up for the scheduled flight without prior notice, all return or onward itinerary would be cancelled by airline automatically.

Please note that the terms and conditions for cancellation of bookings and purchases will vary for each product and service. Please therefore refer to the terms and conditions for a specific product or service or alternatively, check with our Customer Service Team during office hours. Cancellation may be subject to cancellation fees which you agree to bear in full. Please note that cancellation after air tickets are issued is not permitted.

You agree to bear the full cost of any booking, cancellation and administration fees for any products or services booked but not utilized for any reason. Travelbolt.com may charge cancellation and/or amendment fees in addition to those imposed by travel service providers.

International Travel: Passports, Visas, Hazards and Disinfection

Travel to certain destinations may involve greater risk than others. Travelbolt.com therefore urges passengers to review travel prohibitions, warnings, announcements and advisories issued by the Hong Kong Government prior to booking tickets to international destinations. At Travelbolt.com, we shall not be responsible in providing information regarding foreign entry requirements (such as the need for passports and visas).
